Terms of service
OYDA – GENERAL TERMS AND CONDITIONS
Last updated: July 2026
Welcome to OYDA, the online store operated by SAV GmbH.
These General Terms and Conditions govern purchases made through www.oyda.store and define the contractual relationship between SAV GmbH and its customers.
Please read these Terms carefully before placing an order.
1. Provider and Contractual Partner
The seller and contractual partner for purchases made through the OYDA online store is:
SAV GmbH
Operating under the brand OYDA
Capistrangasse 5/2/62
1060 Vienna
Austria
Managing Director: Serge Aryan Vossoughi
Company Registration Number: FN 31813 i
Company Register Court: Handelsgericht Wien
VAT Identification Number: ATU14452607
Email: office@oyda.store
Website: www.oyda.store
OYDA is the commercial store and brand name operated by SAV GmbH. Unless expressly stated otherwise, contracts are concluded exclusively with SAV GmbH.
2. Scope of Application
These Terms apply to all orders placed through the OYDA online store.
OYDA may offer products including:
· Clothing and apparel
· Accessories
· Posters
· Open-edition prints
· Limited-edition prints
· Fine-art photography
· Art objects
· Design products
· Products from selected brands, artists, and collaborators
· Print-on-demand products
· Personalised or customised products
· Digital products, where offered
These Terms apply to both consumers and business customers unless a provision expressly states otherwise.
A consumer is a natural person who enters into a transaction for purposes that are predominantly outside their trade, business, craft, or profession.
A business customer is a natural or legal person or partnership acting for purposes connected with its commercial or professional activities.
Mandatory statutory consumer rights remain unaffected.
3. Product Information and Presentation
The essential characteristics of each product are described on the relevant product page.
Product images, mockups, visualisations, photographs, videos, and colour representations are intended to illustrate the product as accurately as reasonably possible.
However, the appearance of a product may vary slightly due to:
· Individual screen and display settings
· Lighting conditions
· The production method
· The type of fabric, paper, ink, or material
· The size or format selected
· The position of a print on a garment
· Handcrafted or artisanal production
· Technically unavoidable production tolerances
Such variations do not constitute a defect where they are minor, customary, technically unavoidable, and do not materially affect the agreed characteristics, quality, functionality, or overall appearance of the product.
Product dimensions and measurements are approximate unless expressly stated to be exact.
Customers should review product descriptions, size guides, materials, care instructions, and other information before ordering.
4. Print-on-Demand and Made-to-Order Products
Many OYDA products are manufactured using print-on-demand or made-to-order production.
This means that production may begin only after an order has been accepted.
Print-on-demand products may be produced by:
· Gelato
· Other international print-on-demand providers
· Specialist manufacturers
· Fine-art printing laboratories
· Independent production partners
· Local or regional suppliers
A product is not considered personalised or customised solely because it is produced after the order is placed.
Standard products produced on demand remain subject to the statutory consumer withdrawal rights unless a specific legal exception applies.
Products that are individually personalised, created according to customer specifications, or clearly tailored to the customer’s personal requirements may be excluded from the statutory right of withdrawal.
5. Availability
Product offers are subject to availability.
In exceptional cases, a product may become unavailable after an order has been placed, for example because:
· Materials are no longer available
· A production partner has discontinued the product
· A required size, colour, or format cannot be supplied
· Production is technically impossible
· A pricing or product-data error has occurred
· Delivery to the selected destination is not possible
If an ordered product cannot be supplied, we will notify the customer without undue delay.
Any payment already received for the unavailable product will be refunded using the original payment method unless another method has been expressly agreed.
Where only part of an order is unavailable, the remaining products may still be delivered unless the customer reasonably no longer has an interest in partial fulfilment.
6. Order Process and Formation of the Contract
The presentation of products in the online store does not constitute a legally binding offer. It is an invitation to the customer to place an order.
The customer can select products, add them to the shopping cart, and review and correct the order before submitting it.
By clicking the button clearly indicating an obligation to pay, the customer submits a binding offer to purchase the selected products.
After the order has been submitted, the customer normally receives an automated email confirming that the order has been received.
Unless the confirmation expressly states that the order has been accepted, an automated acknowledgement of receipt does not by itself constitute acceptance of the order.
A contract is concluded when we:
· Send an express order-acceptance confirmation;
· Confirm that production has begun;
· Confirm dispatch of the product; or
· Otherwise expressly accept the order.
Where payment is authorised or charged before the contract is accepted, this does not prevent us from rejecting the order for a legitimate reason. In that case, the amount charged will be refunded without undue delay.
We may reject an order for legitimate reasons, including:
· Product unavailability
· An obvious pricing or product-description error
· Suspected fraud or unauthorised payment
· Failure of payment authorisation
· Incomplete or implausible customer information
· Legal restrictions
· Export or delivery restrictions
· Suspected commercial resale contrary to an agreed limitation
· Technical impossibility of fulfilment
We will not reject an order on unlawful or discriminatory grounds.
7. Prices, Taxes, and Shipping Costs
The prices displayed in the online store apply at the time the order is placed.
Where legally required, prices shown to consumers include applicable value-added tax or comparable sales taxes.
Unless expressly stated otherwise, product prices do not include:
· Shipping costs
· Customs duties
· Import taxes
· Brokerage fees
· Charges imposed by authorities or delivery providers in the destination country
Shipping costs and other charges collected by OYDA are displayed during checkout before the order is submitted.
For deliveries outside the European Union or outside the relevant customs territory, additional duties, taxes, or charges may be imposed by the destination country.
Such charges are generally payable by the recipient unless expressly stated otherwise during checkout.
8. Payment
Available payment methods are displayed during checkout and may include:
· Shopify Payments
· Credit or debit cards
· PayPal
· Klarna, where available
· Shop Pay
· Apple Pay
· Google Pay
· Other payment services shown during checkout
Payment processing is provided by independent payment service providers.
The customer may also be subject to the payment provider’s own contractual terms and privacy policy.
OYDA does not normally store complete payment card numbers.
The purchase price becomes due according to the payment method selected during checkout.
If payment cannot be completed, is reversed, or is rejected, we may suspend production or delivery and request another valid payment method.
The customer is responsible for ensuring that sufficient funds and accurate payment information are available.
9. Retention of Title
Products remain the property of SAV GmbH until the purchase price and all amounts directly associated with the order have been paid in full.
For consumers, this provision does not restrict statutory rights regarding possession, delivery, risk, or warranty.
10. Production and Delivery
Production times and delivery estimates are shown on the website, in the Shipping Policy, or during checkout.
Estimated production periods may vary depending on:
· Product category
· Product size or format
· Production capacity
· Material availability
· Production location
· Destination
· Seasonal workload
· Public holidays
Production times and shipping times are separate.
Orders may be produced and shipped from different locations. Products from the same order may therefore arrive in separate packages and at different times.
Unless a specific binding delivery date has been expressly agreed, delivery dates are estimates.
We will deliver orders without unnecessary delay and within the period agreed with the customer.
Mandatory consumer rights in the event of late or failed delivery remain unaffected.
11. Delivery Address
The customer must provide a complete and accurate billing and delivery address.
The customer should verify in particular:
· Name of the recipient
· Street and house number
· Apartment or unit number
· Postal code
· City
· Country
· Telephone number, where required for delivery
· Access or delivery instructions, where relevant
Customers should contact us immediately after ordering if an address correction is required.
We cannot guarantee that an address can be changed once production or shipping has begun.
If delivery fails because the customer supplied incorrect or incomplete information, refused delivery, or failed to collect the package, the customer may be responsible for reasonable additional costs caused by the failed delivery.
For consumers, this applies only to the extent permitted by mandatory law and only where the failed delivery was attributable to the customer.
12. Transfer of Risk
For consumer purchases, the risk of accidental loss or damage generally passes to the customer when the customer or a third party designated by the customer physically receives the goods.
This does not apply where the customer independently commissions a carrier that was not offered by OYDA.
For business customers, the risk generally passes when the order is handed over to the shipping carrier, unless otherwise expressly agreed.
13. Customs and Import Requirements
Customers ordering delivery outside the country or customs territory of production may be required to pay:
· Customs duties
· Import value-added tax
· Clearance charges
· Handling fees
· Other local taxes or charges
Customers are responsible for complying with import restrictions applicable in the destination country.
OYDA is not responsible for a customer’s failure to obtain required import authorisations or to pay charges imposed by local authorities.
However, this does not affect statutory rights where OYDA expressly agreed to deliver a product inclusive of customs clearance or duties.
14. Consumer Right of Withdrawal
Consumers generally have the right to withdraw from an online purchase contract within fourteen days without providing a reason.
For contracts involving goods, the withdrawal period generally begins on the day on which the consumer or a third party designated by the consumer, other than the carrier, receives the goods.
Where several goods are ordered together but delivered separately, the period generally begins when the final item is received.
To exercise the right of withdrawal, the consumer must inform us through a clear statement before the withdrawal period expires.
Withdrawal notices may be sent to:
SAV GmbH / OYDA
Capistrangasse 5/2/62
1060 Vienna
Austria
Email: office@oyda.store
The customer may use the statutory model withdrawal form, but this is not mandatory.
Detailed information concerning the right of withdrawal, return procedure, return costs, refunds, and the model withdrawal form is provided in our separate Withdrawal and Refund Policy.
15. Exceptions to the Right of Withdrawal
The statutory right of withdrawal may not apply to contracts for:
· Goods made according to the customer’s individual specifications;
· Goods clearly personalised or tailored to the customer’s personal requirements;
· Sealed goods that are unsuitable for return for health-protection or hygiene reasons, where the seal has been removed after delivery;
· Digital content not supplied on a physical medium, where performance has begun with the consumer’s prior express consent and acknowledgement that the withdrawal right will consequently be lost;
· Other goods or services excluded from withdrawal under applicable law.
A standard product is not excluded from withdrawal merely because it was produced using print-on-demand after the order was placed.
The relevant exception will be clearly identified before the order is completed where applicable.
16. Returns and Refunds
Returns based on the statutory right of withdrawal are governed by our Withdrawal and Refund Policy.
Unless OYDA has agreed to collect the goods, the customer must generally return them within fourteen days after notifying us of the withdrawal.
The customer may be required to pay the direct costs of returning the goods where this was disclosed before the purchase.
Returned goods should be appropriately packaged to prevent avoidable damage during transport.
Consumers may inspect products in the same way they could reasonably inspect them in a physical shop.
The consumer may be responsible for a reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Refunds will generally be made using the same payment method used for the original purchase unless otherwise agreed.
We may withhold reimbursement until we have received the returned goods or the customer has provided evidence that the goods have been sent back, whichever occurs first, where legally permitted.
17. Incorrect, Damaged, or Defective Products
The statutory right of withdrawal is separate from warranty rights relating to defective, damaged, or incorrectly supplied products.
If a product:
· Arrives damaged;
· Has a manufacturing defect;
· Is materially different from the product ordered;
· Is delivered in the wrong size, format, or design due to our error; or
· Does not have the contractually agreed characteristics,
the customer should contact:
office@oyda.store
Customers should, where reasonably possible, provide:
· The order number
· A description of the issue
· Photographs of the product
· Photographs of the packaging
· Photographs of the shipping label
· Any other information reasonably required to assess the claim
A consumer’s failure to report a defect immediately does not automatically remove mandatory statutory warranty rights.
Visible transport damage should nevertheless be reported as soon as reasonably possible so that we can investigate the matter with the shipping or fulfillment provider.
18. Statutory Warranty Rights
Consumers are entitled to statutory warranty rights under applicable law.
Where Austrian consumer warranty law applies, the customer may initially request that the product be brought into conformity through repair or replacement, subject to the statutory conditions.
A price reduction or termination of the contract may be available where the legal requirements are met, including where:
· Repair or replacement is impossible;
· The remedy would involve disproportionate effort;
· The defect is sufficiently serious;
· The defect continues despite an attempted remedy;
· The remedy is not provided within a reasonable period; or
· The remedy would cause significant inconvenience to the consumer.
A contract cannot generally be terminated for a merely minor defect.
Statutory limitation periods and evidentiary rules apply.
Nothing in these Terms limits or excludes mandatory consumer warranty rights.
19. Business Customers and Duty to Inspect
Where a purchase is a business-to-business transaction, the customer must inspect the goods after delivery within the period appropriate in the ordinary course of business.
Defects that are identified or should have been identified during a proper inspection must be reported within a reasonable period.
Hidden defects must be reported within a reasonable period after discovery.
The inspection and notification obligations under Section 377 of the Austrian Commercial Code may apply.
This section does not apply to consumers.
20. Product Care and Customer Modifications
Customers must follow any care, washing, installation, safety, or handling instructions supplied with the product or displayed on the product page.
Normal wear and tear, improper use, incorrect washing, incorrect storage, accidental damage, or failure to follow care instructions do not constitute manufacturing defects.
Some OYDA content may show creative modifications, cutting techniques, styling ideas, customisation, or do-it-yourself alterations.
Any alteration carried out by the customer is undertaken at the customer’s own discretion and risk.
OYDA is not responsible for damage caused by:
· Incorrect cutting or alteration
· Improper use of tools
· Incorrect washing after modification
· Changes to fit or stability
· Customer-added materials
· Failure to follow safety instructions
· Modification by a third party
This does not exclude responsibility for defective instructions supplied by OYDA or any liability that cannot legally be excluded.
Modified products may no longer be eligible for return where the modification has reduced their value or makes resale unreasonable.
Mandatory statutory rights relating to defects that existed before the customer’s modification remain unaffected.
21. Digital Products
Where digital content is offered, the relevant product page will describe:
· The type of digital content
· File formats
· Technical requirements
· Compatibility
· Usage rights
· Download or access conditions
· Any restrictions
Unless expressly stated otherwise, purchasing digital content grants the customer a limited, non-exclusive, non-transferable right to use the content for personal purposes.
The purchase does not transfer copyright or commercial exploitation rights.
The right of withdrawal for digital content may expire before the fourteen-day period ends only where the consumer:
· Expressly requests immediate performance;
· Expressly consents to the performance beginning during the withdrawal period; and
· Acknowledges that the right of withdrawal will be lost once performance begins.
Mandatory statutory rights relating to defective digital content remain unaffected.
22. Intellectual Property
All photographs, designs, artworks, illustrations, graphics, logos, texts, videos, product concepts, layouts, and other creative materials displayed through OYDA are protected by applicable copyright, trademark, design, and intellectual property laws.
The relevant rights may belong to:
· SAV GmbH
· Sascha van der Werf
· OYDA
· Participating artists
· Participating designers
· Partner brands
· Licensors
· Manufacturers
· Other identified rights holders
The purchase of a physical or digital product does not transfer:
· Copyright
· Reproduction rights
· Publication rights
· Commercial usage rights
· Trademark rights
· Design rights
· Merchandising rights
· Rights to create derivative products
Unless expressly permitted, customers may not reproduce, scan, photograph for commercial reproduction, distribute, publish, modify, resell as content, mint as a digital token, use for machine-learning training, or commercially exploit protected materials.
Resale of a lawfully purchased physical product remains subject to applicable mandatory law.
23. Reviews and Customer Content
Where customers submit reviews, photographs, comments, or other content, they remain responsible for that content.
Customers must not submit content that:
· Infringes intellectual property rights
· Violates privacy or personality rights
· Is unlawful
· Is misleading
· Contains malicious software
· Is threatening, discriminatory, or defamatory
· Contains unauthorised advertising
Where necessary to display and administer submitted content, the customer grants SAV GmbH a non-exclusive, worldwide, royalty-free licence to host, reproduce, technically adapt, and display that content in connection with OYDA.
We may remove content where we reasonably believe that it violates these Terms or applicable law.
24. Liability
SAV GmbH is liable without limitation where liability cannot legally be limited or excluded, including:
· Intentional misconduct
· Personal injury
· Liability under mandatory product-liability law
· Other mandatory statutory liability
For consumers, liability is governed by mandatory applicable law.
Nothing in these Terms excludes liability for gross negligence where such an exclusion would be unlawful.
We are not responsible for circumstances outside our reasonable control, but this does not remove statutory consumer rights relating to delivery, performance, refunds, or defective goods.
We are not liable for damage caused solely by:
· Incorrect information supplied by the customer
· Improper use of a product
· Failure to follow care or safety instructions
· Unauthorised modification
· Ordinary wear and tear
· Incompatible customer equipment that was not stated to be supported
· Unlawful use of a product
For business customers, liability for minor negligence is excluded to the extent legally permissible, except in cases of personal injury or breach of a fundamental contractual obligation.
Where liability to a business customer for minor negligence cannot be excluded, it is limited to foreseeable damage typical for the contract.
25. Force Majeure and Events Outside Our Control
Production or delivery may be affected by events outside our reasonable control, including:
· Natural disasters
· Severe weather
· Fire
· Flood
· Epidemics or pandemics
· War
· Terrorism
· Civil unrest
· Strikes
· Transport interruptions
· Government measures
· Customs restrictions
· Energy or network failures
· Material shortages
· Serious disruption affecting suppliers or production partners
Where such an event prevents or significantly delays performance, we will inform affected customers where reasonably possible.
The parties’ statutory rights, including consumer rights regarding delayed or impossible performance, remain unaffected.
26. Data Protection
Personal data is processed in accordance with our Privacy Policy.
To process an order, information may be shared with service providers involved in:
· Payment processing
· Fraud prevention
· Production
· Fulfillment
· Shipping
· Customer support
· Accounting
· IT infrastructure
Further information is available in the OYDA Privacy Policy.
27. External Services and Links
The website may contain links to services operated by third parties.
Third-party websites, platforms, payment services, and social media providers operate under their own terms and privacy policies.
SAV GmbH is not responsible for third-party content or services outside its reasonable control.
This does not affect liability where SAV GmbH has unlawfully selected, presented, or recommended third-party content.
28. Governing Law
These Terms and contracts concluded through the OYDA online store are governed by Austrian law, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive the consumer of mandatory protections granted by the law of the country in which the consumer has their habitual residence, where that law is applicable.
29. Jurisdiction
For consumers, the statutory rules concerning jurisdiction apply.
Nothing in these Terms restricts a consumer’s right to bring proceedings before a court that has jurisdiction under mandatory applicable law.
For business customers, the competent court in Vienna, Austria, shall have exclusive jurisdiction to the extent legally permissible.
SAV GmbH also reserves the right to bring proceedings against a business customer at the customer’s general place of jurisdiction.
30. Alternative Dispute Resolution
We aim to resolve customer complaints directly.
Customers may contact:
office@oyda.store
SAV GmbH is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board unless participation is required by applicable law.
31. Changes to These Terms
The version of these Terms in effect when the order is placed applies to that order.
We may amend these Terms for future transactions to reflect:
· Legal developments
· Changes to the online store
· New products or services
· Changes to payment or fulfillment methods
· Technical or operational developments
Changes do not apply retroactively to completed purchases unless expressly agreed or legally required.
32. Severability
If any provision of these Terms is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.
For consumers, an invalid provision will be replaced by the applicable statutory rule.
This clause does not authorise an interpretation or reduction of an unlawful contractual provision where such an approach is prohibited by consumer law.
